Allegations
This lawsuit seeks enforcement of the Judgment entered against Arctic and D&A in the District Court litigation. Comerica is liable for Class Members’ escrows because maintenance escrow funds wrongfully withheld from class members are subject to statutory trust created by truth-in-leasing regulations. Maintenance escrows awarded to the Class by entry of Judgment in the District Court Litigation must be returned by Comerica because the funds were deposited with Comerica and used to pay Arctic’s debt to Comerica. Class Members will receive the bulk of their share of the Judgment only if we succeed in enforcing the Judgment against Comerica.
