Allegations
OOIDA alleges that the rulemaking is arbitrary and capricious because FMCSA had made no showing how EOBRs would improve safety; that EOBRs would be a violation of a drivers’ right to privacy under the Fourth Amendment; that the agency did little to address the effect the rule would have on driver health and that it did nothing to ensure motor carriers would not use EOBRs to harass drivers.
