Allegations
The lawsuit alleged violations of the Truth-in-Leasing regulations by failing to return, and pay interest upon, escrow funds; failure to pay compensation and undisclosed charge-backs. A class of drivers leased to Ledar between approximately June 1996 and January 2001 was certified in 2002. On March 31, 2008, the Court entered judgment, jointly and severally, against Ledar, Hawthorne Leasing, Carl Higgs, Norma Higgs and Scott Higgs and in favor of plaintiffs and class members in the amount of $996,601.53 to over 600 class members. The Court also awarded attorneys’ fees and costs in the amount of $1,086,676.30. The total judgment entered against the Defendants is $2,083,277.83.
