Major Legal Accomplishments
- In litigation OOIDA brought against the State of Alabama in 1991, class members were awarded $70 million in tax refunds for a marker fee that violated the Commerce Clause. OOIDA has since pursued legal action against approximately 30 states resulting in refunds of several hundred million dollars to truckers in addition to stopping the proliferation of unconstitutional practice of discriminatory and burdensome taxes and permit requirements.
- In the early 90s, OOIDA brought suit against the Tennessee Public Service Commission over abusive enforcement tactics and violations of truckers’ rights. OOIDA’s court action ended those practices and was a direct factor in the total abolishment of the agency.
- In 1992, OOIDA challenged a four-state pilot program implementing random drug testing of truck drivers which eventually met with a favorable ruling in the higher courts.
- In 2008, OOIDA secured a Court of Appeals’ decision in its case against Landstar, that carriers must strictly comply with the federal leasing regulations, and that truckers have the right to complete, transparent and truthful disclosures from carriers regarding how their compensation – and deductions from that compensation – are calculated, or they will be subject to liability for any violations. The decision, coming from one of the highest courts in the country short of the Supreme Court, unconditionally endorses the standards OOIDA has advocated in this and many other cases on behalf of OOIDA’s members.
- To date, OOIDA has achieved favorable judgments in class actions against motor these carriers for violations of federal leasing regulations, resulting in settlements or damages for return of funds to owner-operators. More importantly it has resulted in business practices being revised and leases brought into compliance.
