7/23/04-Gov. Bill Owens has signed a bill into law authorizing the Colorado Department of Revenue to adopt and administer procedures for licensing drivers of commercial vehicles in accordance with applicable federal laws and rules regarding commercial motor vehicle safety.
The new law, previously HB1231, requires the department to maintain for at least three years records of persons applying for a CDL plus any convictions, disqualifications, or violations of state or local laws relating to motor vehicle traffic control committed while in operation of a CMV. The department is required to provide such records or disqualifications to specified persons and entities.
In addition, the legislation authorizes fingerprinting by a state or local law enforcement agent for the purpose of a criminal history check if a person wants to obtain a hazardous material endorsement to his/her CDL.
The new law will take effect July 1, 2005.
