7/9/04-Gov. Kathleen Blanco signed a bill into law June 25 requiring the operating record of a commercial motor vehicle driver to include motor vehicle violations “where an individual has pled guilty … or been found guilty … of violating a law in the operation of a motor vehicle, regulatory actions in which an individual has been adjudged at fault, and any accident in which the driving privileges of the person are suspended for failure to provide liability security or proof of financial security.”
The new law, previously HB991, will take effect Aug. 15.
It includes a requirement that beginning Jan. 1, 2005, the Department of Public Safety and Corrections develop a system to allow a motor carrier to elect to receive electronic notification when a driver operating under its authority is cited for a moving violation on a department motor carrier safety inspection report as soon as possible after the report has been entered into the appropriate department database, but not more than 60 days after the issuance of the citation.
6/22/04-The House gave final approval to a bill June 15 that would require the operating record of a commercial motor vehicle driver to include motor vehicle violations “where an individual has pled guilty … or been found guilty … of violating a law in the operation of a motor vehicle, regulatory actions in which an individual has been adjudged at fault, and any accident in which the driving privileges of the person are suspended for failure to provide liability security or proof of financial security.”
The bill, sponsored by Rep. Mike Futrell, R-Baton Rouge, passed the Senate with changes June 10. It now heads to Gov. Kathleen Blanco.

6/14/04-The Senate unanimously approved a bill June 10 that would require the operating record of a commercial motor vehicle driver to include motor vehicle violations “where an individual has pled guilty … or been found guilty … of violating a law in the operation of a motor vehicle, regulatory actions in which an individual has been adjudged at fault, and any accident in which the driving privileges of the person are suspended for failure to provide liability security or proof of financial security.”
HB991, which previously passed the House, has been sent back to the chamber for approval of Senate changes before heading to Gov. Kathleen Blanco.

The House-approved version sought a copy of all motor carrier inspection reports containing any driver moving violations to the motor carrier identified in such report within 45 days of the inspection.

5/7/04-The House approved a bill 103-0 May 6 that would require the operating record of a commercial motor vehicle driver to include motor vehicle violations “where an individual has pled guilty and been sentenced thereupon, forfeited bond resulting in a final judgment of forfeiture, or been found guilty in a final disposition by a court of competent jurisdiction of violating a law in the operation of a motor vehicle, regulatory actions in which an individual has been adjudged at fault, and any accident in which the driving privileges of the person are suspended for failure to provide liability security or proof of financial security.”
HB991, sponsored by Rep. Mike Futrell, R-Baton Rouge, would also add a requirement that beginning Jan. 1, 2005, the Department of Public Safety and Corrections forward a copy of all motor carrier inspection reports containing any driver moving violations to the motor carrier identified in such report within 45 days of the inspection.
The bill is awaiting committee assignment in the Senate.
