11/29/05-A bill that would have given the state’s attorney general more power to go after price gougers has died.
SB52, sponsored by Sen. Ed Murray, D-New Orleans, remained in the House Committee on Judiciary when the special session ended Nov. 22. It previously passed the Senate on a 22-14 vote.
The bill sought to enable Louisiana’s attorney general to shut down businesses if the office determined they were jeopardizing public safety or welfare during an emergency declared by the governor.
The bill would have required the attorney general to explain the reason for the “cease and desist” orders issued under the law.
Existing Louisiana law describes price gouging on goods and services when the cost “grossly exceeds” the ordinary charges for comparable items in the same market. The law recognizes that the cost of providing services could increase during emergency situations.
