6/27/05-A bill that would have increased the fine by $2,000 for drivers who refuse to take a breath test after being pulled over for suspicion of driving while intoxicated has died.
HB3241, sponsored by Rep. Todd Smith, R-Bedford, remained in the House Law Enforcement Committee at the deadline for bills to pass from the chamber, effectively killing it for the year.
The bill also allowed first-time offenders who agree to a breath test the option of deferred adjudication – a lesser sentence which keep’s the individual’s record free from a conviction if they comply with the judge’s terms.
