The new law, previously HB1003, requires private tolling companies to obtain approval from the Colorado Department of Transportation before moving forward with any plans.
6/2/06-A bill awaiting Gov. Bill Owens’ signature would create more state oversight of private toll-road projects.
HB1003, sponsored by Rep. Jack Pommer, D-Boulder, would require private tolling companies to obtain approval from the Colorado Department of Transportation before moving forward with any plans.
Groundbreaking on a toll route would be required to begin within three years after incorporation. It also would require that investors spend at least $500,000 or forfeit all rights.
In addition, the bill would reduce the right of way from 12 miles to three miles as well as require notice to be given to all local governments and forbid the condemning authority to commercially develop in that zone.
