5/30/08-A bill has died that sought to give law enforcement officers more power during roadside stops.
Sponsored by Rep. David Grimes, R-Montgomery, HB35 advanced from committee to the House floor only to be was “indefinitely postponed.” The status effectively killed the bill for the year.
The bill would have allowed officers during investigations of wrecks to arrest people for any misdemeanor traffic offense where there is probable cause.
Existing state law does not generally authority an officer to arrest a person for a misdemeanor traffic offense that is not committed in the presence of the officer.
