5/21/08-Gov. Kathleen Sebelius has signed a bill into law to mandate that drivers involved in “serious” traffic wrecks be required to submit to alcohol and drug testing. It takes effect July 1.
State law already allows law enforcement officers to order testing if there is “reasonable suspicion” the person is under the influence. The new law, previously HB2617, would require truckers and other drivers to undergo drug and alcohol testing when they are involved in certain types of wrecks.
Officers no longer need the presumption of an alcohol or drug violation to force drivers to submit to the testing.
A provision was removed from the bill while it was winding its way through the statehouse that would have required drivers, as well as their passengers, to undergo testing.
The final version of the bill includes a provision to permit people to refuse to allow blood to be drawn. Taking that route, however, could result in loss of driving privileges.

2/19/08-The House voted 117-5 to approve a bill that would require drivers and passengers involved in “major” traffic wrecks to be required to submit to drug testing. It now moves to the Senate.
State law now allows law enforcement officers to order drug testing, frequently a blood sample, if there is “reasonable suspicion” the person is under the influence.
HB2617 would require truckers and other drivers, as well as their passengers, to undergo drug testing when they are involved in certain types of wrecks. The presumption of a drug violation would not be needed to mandate testing.
A provision added to the bill would permit people to refuse to allow blood to be drawn. Taking that route, however, could result in loss of driving privileges. Another change to the bill would authorize officers to waive the blood test requirement if they believe the actions of the driver did not contribute to the wreck.
The bill is awaiting consideration in the Senate Judiciary Committee.
