11/25/09-Gov. Donald Carcieri has signed a bill into law allowing police to obtain search warrants compelling chemical substance tests for certain suspected drunken drivers.
After obtaining a search warrant, H5039 gives officers the authority to have hospitals take blood from drunken-driving suspects who are involved in serious or fatal wrecks. Any chemical testing must be on audio and videotape.
Hospitals also can draw blood from suspects before a warrant is obtained. They would be required to hold it until the warrant is approved.
Blood samples could only be required after the suspected offender had refused to take a breathalyzer test.

11/3/09-Senate lawmakers voted to send to Gov. Donald Carcieri a bill that would allow police to obtain search warrants compelling chemical substance tests for certain suspected drunken drivers. House lawmakers approved the bill during the summer.
After obtaining a search warrant, H5039 would give officers the authority to take blood from drunken-driving suspects who are involved in serious or fatal wrecks. Any chemical testing must be on audio and videotape.
