Allegations
AAFAB violated the Truth-in-Leasing regulations by keeping owner-operators’ escrow accounts as a penalty when the owner-operator failed to give three days written notice of their intent to terminate their lease. The Court denied AAFAB’s Motion to Dismiss and AAFAB paid the two owner-operators their escrow balances. The Court also ordered AAFAB to pay a part of the plaintiff’s attorney’s fees. The plaintiff’s attorneys garnished AAFAB’s bank account when they refused to pay. Payment has been received and the matter is now closed.
