Allegations

OOIDA filed a lawsuit against NAVL for violation of the Truth-in-Leasing regulations, specifically; operation without a written lease; failure to calculate compensation properly and to provide required information to validate compensation; unlawful forfeiture of fuel tax credits; unlawful charge to owner-operators of public liability insurance; unlawful charge-back of fees to fund NAVL’s government safety and compliance programs (BIPD Fund); unlawful forfeiture of BIPD funds; and unlawful forced purchase of products and services.

The North American Van Lines case was transferred to the Northern District of Indiana and combined with the Allied Van Lines case.  Both cases were settled for $8 million in April 2007.  The Van Lines filed for Chapter 11 bankruptcy protection in February 2008, however; OOIDA was able to recover $4.2 million.  The money was distributed to the class members.
