Out-of-state trucking businesses that go into New York can thank small-business truckers for standing up to an unconstitutional tax and decal fee. The Owner-Operator Independent Drivers Association has won a class-action lawsuit against the state and the fee will no longer be enforced.

The Owner-Operator Independent Drivers Association announced today that a federal court judge ruled in OOIDA’s favor regarding the Association’s ongoing DataQ lawsuit.The U.S. Court of Appeals for the District of Columbia Circuit denied the U.S. Department of Transportation’s motion to dismiss a complaint filed by OOIDA challenging the accuracy of the data the department maintains and reports about truck drivers under the Privacy Act.
