The Owner-Operator Independent Drivers Association is leading a coalition of dozens of influential trade associations to oppose four burdensome, costly, and unsafe trucking mandates. Today the coalition sent a letter to Congress urging them to reject those proposals as they work on the next surface transportation reauthorization.
A common sense approach has finally been proposed by the federal government regarding how long truck drivers work and drive. The Owner-Operator Independent Drivers Association thanks the Federal Motor Carrier Safety Administration for listening to truck drivers’ concerns and including provisions that make it easier for them to avoid heavy traffic, bad weather and other less than ideal situations.
The Owner-Operator Independent Drivers Association had filed the lawsuit in early 2018 because Virginia was unlawfully writing warnings and citations for violations against the 30-minute break provision of hours-of-service. That provision had been added to regulations in 2015, but Virginia did not adopt it into state law until late 2017.
The Owner-Operator Independent Drivers Association is concerned about a recent decision by the Federal Motor Carrier Safety Administration to preempt meal and rest break laws in California.The FMCSA granted a petition that, effective immediately, preempts California state laws that deal with meal and rest breaks for truck drivers. The American Trucking Associations (ATA) submitted the petition last year requesting federal preemption, citing numerous issues such as conflicts with the federal hours-of-service regulations.

The Owner-Operator Independent Drivers Association, the nation’s only organization exclusively representing professional and small-business truckers, supports legislation introduced by U.S. Rep. Brian Babin (R-TX-36) to modernize hours-of-service regulations.The Responsible and Effective Standards for Truckers, or REST Act, H.R.5417, would allow drivers to take one rest break per shift, for up to three consecutive hours. This single off-duty period would not be counted toward the driver’s 14-hour, on-duty allowance. The bill would not extend the total, allowable drive time limits.
